     2015年12月22日,质检总局正式公布了《缺陷汽车产品召回管理条例实施办法》(以下简称办法),该管理办法将于2016年1月1日起正式实施。

  12月21日,质检总局执法督查司司长严冯敏在质检总局召开的新闻发布会上表示,截至2015年12月18日,共有76家企业开展了226次汽车召回活动,涉及缺陷汽车554.85万辆,召回次数和数量同比分别增长29%、17%,均创历史新高。其中,汽车企业受质检总局缺陷调查影响共实施召回活动81次,较去年同期增长170%,涉及缺陷汽车352.23万辆,较去年同期增长18%,占全部召回数量的64%。

  在整体汽车召回数字创新高的同时,国内自主品牌发起的召回却少之又少。根据质检总局官网的汽车召回信息粗略统计,截至2015年12月18日,国内自主品牌的汽车召回总量约为76万辆,约占召回总数的13%,在召回次数方面,国内自主品牌的召回数量约为14次,约占总召回次数的6%。

  在新能源汽车领域,国内自主品牌更是没有任何一起公开召回电动汽车的案例。

  然而,中国电动汽车网的记者从一些电动汽车车主处了解到,并不是所有的电动汽车都毫无安全隐患,而是通常车企都不愿意将召回行为公开,更倾向于采用“秘密召回”的手段:由客服直接联系购买了相关车型的车主,或者直接对有质量问题的车型实行延保以替代召回。

  制度将完善:生产者成缺陷汽车召回责任主体

  在此次公布的《办法》中,第三条里明确规定了汽车产品生产者是缺陷汽车产品的召回主体,也就是说,明年起生产者将成为召回的第一责任人。

  这就进一步要求了国内自主品牌需要摆脱对召回行为的“心里阴影”,积极主动地承担起召回的责任,不能暗度陈仓实行秘密召回的手段。

  《办法》规定,凡生产者经调查分析确认汽车产品存在缺陷的,应当立即停止生产、销售、进口缺陷汽车产品,并实施召回;生产者经调查分析认为汽车产品不存在缺陷的,应当在报送的调查分析结果中说明分析过程、方法、风险评估意见以及分析结论等。

  除此之外,《办法》中对生产者信息收集分析报告义务、自行开展缺陷调查上报、接受主管部门监督、生产者异议申诉、备案召回计划、上报召回总结报告等情况,做出了明确的要求。

  其次,还规定实行质检总局和省级质检部门二级监管模式,强调了省级质检部门对本行政区域内汽车产品召回实施监督的相关职责。

  宝马与特斯拉的召回事件经验

  召回是整车企业对消费者负责任的表现,不应只关注主动召回车辆而带来的短期损失。更不必在召回时抱有“藏着掖着”的态度。

  国际过往召回的案例中有不少的经验与教训可供国内的新能源汽车企业参考,其中有两点错误尤其不容忽视:一是车企拒不沟通,召回的态度不积极;二是采用“打补丁”的召回方,不认真彻查问题根源而是做些表面文章。

  就在本月22日,根据外媒的报道,德国豪华汽车厂商宝马因未能及时召回3万余辆Mini Coopers,收到了美国国家公路交通安全管理局4000万美元的罚单。宝马就是犯了召回过程中的第一条大忌:不积极。由此可见,消极应对召回并不能解决问题,反而会产生新的丑闻。

  反观特斯拉在今年的大规模召回事件,其后续的影响总体还是偏向正面。

  11月20日,特斯拉仅因一位车主对安全带脱落的投诉,向包括中国车主在内的全球十万辆Model S车主发出一份邮件通知,对全部9万辆Model S型轿车实施召回,这也是该公司史上规模较大的一次汽车召回。

  特斯拉认为,召回、检测可以确保此情形不存在于到目前为止生产出来的近十万辆Model S中的任何车辆。尽管没有任何证据表明该隐患的存在,特斯拉相信本次召回可以确保Model S车主的绝对安全。

  这种负责任的行为实际上让车主对特斯拉的好感不降反增,一位车主就在接受采访时说到:“因为特斯拉量产车型少,现在尚无法确定这到底是产品设计缺陷,还是一起个案,特斯拉采取全球召回、检验的方式可以理解,也是企业负责任的表现,这并不会影响我对特斯拉的品牌好感。”

  十三五期间推广规模扩大 新能源车更该积极应对召回

  本月,财政部、科技部、工信部、国家发展改革委、国家能源局五部门日前发布《关于“十三五”新能源汽车充电设施奖励政策及加强新能源汽车推广应用的通知(征求意见稿)》。

  按照其中规划,十三五期间整个新能源汽车的推广数量要达到457.1万辆,至2020年要实现总保有量500万辆的目标。

  面对如今不到50万辆的新能源车总量,国内的自主新能源车企尚且能够悄悄实行秘密召回的做法。而随着总保有量的逐渐上升,召回的责任将无法推卸。一旦出现产品质量问题而不进行召回处理,不仅会损毁自家的品牌形象,也会因赔偿和罚款带来更多的经济损失。

  从另一个角度说,对国内自主品牌而言,十三五期间也将是一个重大的发展节点,绝不能研发出产品就置之不理,应该把新能源车的品牌建设好。召回作为售后的重要一环,如果积极应对,也将在消费者中形成良好的口碑。

In the field of new energy vehicles, there is no case of public recall of electric vehicles in China.

In this release of the "measures", the third article clearly stipulates that the auto product producer is the recalling subject of defective automobile products, that is to say, the producer will be the first responsible person for the recall from next year.

This further requires that the domestic independent brands need to get rid of the "heart shadow" of the recall, actively take the responsibility of recall, and can not carry out the secret recalls.

The "measures" stipulates that the producers should immediately stop producing, selling and importing defective automobile products and carrying out a recall after investigation and analysis, and the producers, after investigation and analysis, that the automobile products have no defects, should explain the analysis process, method and wind in the results of the investigation and analysis. Risk assessment and analysis conclusions.

In addition, the "measures" made clear requirements for the producer information collection and analysis report obligations, self-carried defects survey, the supervision of the competent department, the producer objection appeal, the record recalling plan, and the recall summary report.

Secondly, it also stipulates the two level supervision mode of QSIQ and provincial quality inspection department, and emphasizes the related responsibilities of the provincial quality inspection department to supervise the recall of automobile products in the administrative region.

Experience of the recall of BMW and Tesla

Recall is the responsibility of vehicle enterprises to consumers. It should not only focus on short-term losses caused by active recall of vehicles.  There is no need to hide in the recalls.

There are a lot of experience and lessons in the international past recalls for reference to the domestic new energy auto enterprises. There are two mistakes especially: one is that the car enterprises refuse to communicate and the recall attitude is not active; two is to adopt the "patch" recall, not to carefully check the root of the problem but to make some surface articles.

On the 22 day of this month, according to foreign media reports, the German luxury car maker BMW was unable to recall more than 3 million Mini Coopers in time, and received a fine of US $40 million from the national highway traffic safety administration. BMW is the first big mistake in the recall process: it is not active. This shows that passive response to recall can not solve the problem, but will create new scandals.

In view of this year's massive recall, Tesla's overall impact is still positive.

In November 20th, Tesla sent a message to one hundred thousand Model S owners worldwide, including Chinese owners, for a complaint from a car owner on the seatbelt, the recall of all 90 thousand Model S cars, the largest car recall in the history of the company.

Tesla believes that recall and testing can ensure that this situation does not exist in any of the nearly one hundred thousand Model S produced so far. Although there is no evidence of this hidden danger, Tesla believes that this recall can ensure the absolute safety of Model S owners.

This kind of responsible behavior actually makes the owner of Tesla's good feeling no increase, one car owner said in an interview: "because Tesla has fewer products, it is still not sure whether it is a product design defect, or a case, the way Tesla takes global call back and inspection. The performance of corporate responsibility does not affect my brand preference for Tesla. "

Promotion of new energy vehicles in 13th Five-Year should be more active in responding to recall.
